Ask Dan Terms of Service

Welcome to Ask Dan ("Ask Dan," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Ask Dan website, applications, and related services (collectively, the "Service").
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.
1. Description of Service
Ask Dan is an artificial intelligence-powered educational product developed by Limmer Education.
The Service is designed to provide educational content, explanations, study support, test preparation assistance, and critical-thinking development related to Emergency Medical Services (EMS) education.
Ask Dan is designed as a focused educational environment. Responses are generated from Limmer Education content and other approved educational sources rather than unrestricted internet search results.
Ask Dan is intended solely as an educational resource.
2. Eligibility
You must be at least sixteen (16) years old, or the age of majority in your jurisdiction, to create an account.
If you are under eighteen (18), you may use the Service only with the permission and supervision of a parent, guardian, educational institution, or authorized instructor.
3. Educational Use Only
Ask Dan has been developed using the same educational philosophy, clinical rigor, and attention to detail that Limmer Education applies across its learning products.
Ask Dan is designed to help users improve clinical understanding, strengthen critical thinking skills, and build confidence in EMS concepts. However, Ask Dan is an educational resource only and is not intended for use during patient care or emergency response situations.
Users should rely on their training, professional judgment, local protocols, medical direction, and applicable policies when providing patient care.
Ask Dan does not provide:
- Medical advice
- Clinical direction
- Patient care guidance
- Medical oversight
- Legal advice
- Professional certification
Do not use Ask Dan while on scene, during patient encounters, or as a substitute for professional judgment.
4. Artificial Intelligence Disclosure
Ask Dan uses artificial intelligence to generate educational responses.
The Service has been designed to provide accurate and clinically relevant educational content based on Limmer Education materials and approved educational sources. However, no artificial intelligence system is infallible.
Responses may occasionally contain errors, omissions, outdated information, or incorrect interpretations.
Users are responsible for independently evaluating information and should not rely on Ask Dan as the sole basis for clinical, educational, professional, testing, or employment-related decisions.
5. No Guarantee of Outcomes
Use of Ask Dan does not guarantee:
- Course completion
- Examination success
- NREMT certification
- Licensure
- Employment
- Clinical competency
- Any specific educational outcome
Educational success depends on many factors outside the Service.
6. User Responsibility
You assume full responsibility for your use of the Service and any actions taken based on information provided by the Service.
Limmer Education shall not be responsible for decisions, actions, outcomes, losses, injuries, damages, or liabilities arising from reliance upon Ask Dan responses.
7. Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity occurring under your account
- Providing accurate registration information
Subscriptions are intended for individual use only unless otherwise authorized by Limmer Education.
You may not share, transfer, sell, or provide access to your account to another person.
We reserve the right to suspend or terminate accounts that violate these Terms.
8. Subscription and Billing
Access to Ask Dan requires a paid subscription.
Subscriptions automatically renew unless canceled before the next billing cycle.
Subscription fees are charged in advance and are non-refundable except as required by law or as specifically described in our Refund Policy.
We reserve the right to modify subscription pricing. Any pricing changes will apply only to future billing periods.
Early Access pricing, promotional pricing, or grandfathered pricing may be subject to separate terms announced at the time of purchase.
9. Refund Policy
Refund eligibility, if any, is governed by the Ask Dan Refund Policy, which is incorporated into these Terms by reference.
10. Early Access Program
Ask Dan may be offered as an Early Access product.
By participating in Early Access, you acknowledge that:
- Features may be incomplete
- Features may change without notice
- Certain functionality may be added, modified, delayed, or removed
- Bugs, errors, and service interruptions may occur
- User experience may change as the product evolves
Your participation helps us improve the Service.
11. Future Features
Any references to planned, anticipated, or future features are provided for informational purposes only.
We do not guarantee that any specific feature, enhancement, capability, integration, functionality, or release timeline will occur.
12. User Content
You retain ownership of content you submit to Ask Dan.
By submitting content, you grant Limmer Education a non-exclusive, worldwide license to process, store, analyze, and use such content solely for the operation, maintenance, security, support, and improvement of the Service.
You represent that you have the right to submit any content you provide.
13. Acceptable Use
You agree not to:
- Use the Service for actual patient care decisions
- Use the Service while actively providing patient care
- Use the Service to violate applicable laws or regulations
- Upload malicious software or harmful code
- Attempt to reverse engineer, copy, or exploit the Service
- Circumvent security measures
- Share account credentials
- Use automated tools to scrape or extract content from the Service
- Misrepresent AI-generated content as official Limmer Education guidance
- Interfere with the operation of the Service
14. Intellectual Property
The Service, including software, educational content, trademarks, branding, designs, text, graphics, audio, video, and other materials, is owned by Limmer Education or its licensors and is protected by applicable intellectual property laws.
Except as expressly permitted, no portion of the Service may be copied, distributed, reproduced, modified, sold, or commercially exploited without written permission.
15. Availability
We strive to provide reliable access to the Service but do not guarantee uninterrupted availability.
The Service may be unavailable due to maintenance, upgrades, technical issues, third-party service interruptions, or circumstances beyond our control.
16. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMMER EDUCATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND AVAILABILITY.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMMER EDUCATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE.
OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LIMMER EDUCATION FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
18. Indemnification
You agree to indemnify and hold harmless Limmer Education, its owners, employees, contractors, affiliates, and partners from claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.
19. Termination
We may suspend or terminate access to the Service at any time if you violate these Terms or if continued access presents operational, legal, security, or business risks.
You may terminate your account at any time by canceling your subscription.
Termination does not relieve either party of obligations incurred prior to termination.
20. Changes to Terms
We may revise these Terms from time to time.
Updated Terms will be posted on the Service with a revised effective date.
Continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms.
21. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maine, without regard to conflict-of-law principles.
